Terms of Service

The terms that apply when you use Tapstand as a venue owner, staff member or customer.

These terms are an agreement between you and Tapstand ("we", "us"), Kadubeesanahalli, Bengaluru, Karnataka 560103. By creating an account or using Tapstand, you agree to them. If you use Tapstand for a business, you confirm you're authorised to accept these terms for it. These terms are an electronic record under the Information Technology Act, 2000 and need no physical signature.

1. The service

Tapstand gives cafés, restaurants and other venues a page customers open by tapping or scanning a code, with menus, guest Wi-Fi details, a digital loyalty card, feedback and links. Owners manage it from a dashboard; staff use a staff app. We may add, change or remove features over time.

2. Accounts

  • You must be at least 18 and give accurate information.
  • Keep your password safe. You're responsible for activity on your account and your staff accounts.
  • Remove staff access when someone leaves.
  • Tell us straight away if you suspect unauthorised access.

3. Your responsibilities as a venue owner

  • Your content is yours, and so is responsibility for it. Menus, prices, photos, descriptions, offers and links must be accurate and lawful.
  • Food information. You're responsible for veg / non-veg markers, allergen information and other declarations required by the Food Safety and Standards Act, 2006 and FSSAI regulations.
  • Your customers' data. For loyalty and feedback data you are the data fiduciary under the DPDP Act. Use it only for the purposes shown to customers, and respond to their requests.
  • Reviews. Follow the policies of review platforms such as Google. Don't offer incentives for reviews. Limiting the Google review option to certain star ratings is review gating, which Google prohibits; if you enable it, you do so at your own risk.
  • Offers and rewards shown to customers must be honoured as described.

4. Acceptable use

You must not use the service to:

  • Break any law, or infringe anyone's intellectual property or privacy.
  • Publish content that is false, misleading, obscene, defamatory, hateful or harmful, or that is prohibited under rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
  • Send spam or collect data from customers without their consent.
  • Interfere with, probe or overload the service, or try to access other accounts.
  • Resell or copy the service without our written permission.

We may remove content or suspend accounts that break these terms, and will act on lawful orders from courts or the government.

5. Plans, fees and payment

  • Setting up is free. A shop stays free until we switch on billing for it, which we'll agree with you first; paid plans then start after a free trial period.
  • Prices are shown on our pricing page or in your quote, in Indian rupees, and include or exclude GST as stated.
  • Plans renew for the same period (monthly or yearly) until cancelled. If a payment is overdue, we may limit paid features until it's paid.
  • We'll give at least 30 days' notice of any price change for your plan.
  • Cancellations and refunds are covered by our Refund & Cancellation Policy. Physical products such as stands are covered by our Shipping & Delivery Policy.

6. Intellectual property

We own Tapstand, its software, design and brand. You keep ownership of your content and give us a licence to host, display and process it only to provide the service. Feedback you send us about Tapstand may be used to improve it.

7. Third-party services

The service links to and uses third-party services (for example Google, delivery and booking platforms, and our hosting and email providers). Their own terms apply, and we're not responsible for them.

8. Availability and changes

We work to keep the service available but don't guarantee it will be uninterrupted or error-free. We may carry out maintenance, and will try to give notice of planned downtime.

9. Disclaimers and limitation of liability

To the extent permitted by law, the service is provided "as is". We are not liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act, 2019 that cannot be excluded.

10. Indemnity

You agree to compensate us for claims arising from your content, your use of customers' data, or your breach of these terms.

11. Ending the agreement

You can stop using the service and delete your account at any time from your dashboard. We may suspend or end your account if you break these terms, with notice where reasonable. On deletion, your venues and their data are deleted as described in our Privacy Policy.

12. Governing law and disputes

These terms are governed by the laws of India. Please contact our Grievance Officer first; most issues can be resolved quickly. Subject to that, the courts at Bengaluru have exclusive jurisdiction, without affecting consumers' rights to approach consumer commissions under the Consumer Protection Act, 2019.

13. Changes to these terms

We may update these terms. We'll change the date at the top and email account holders about significant changes at least 15 days before they apply. Continuing to use the service means you accept the updated terms.
